The ESA outlines baseline protections, like pay, hours, and basic severance entitlements. But these are minimums, not maximums. If you file a Ministry claim, you give up the right to pursue a wrongful dismissal lawsuit in court, where the financial compensation can be much higher. Before filing, it’s wise to speak with an employment lawyer to determine whether the Ministry process or a legal claim would better serve your interests.
