What Led to Activision Blizzard’s $50 Million Settlement?

Activision Blizzard, a large US video game maker, is paying big money to settle an allegation that it discriminated against its female employees. The company will pay roughly $50 million US to settle a 2021 lawsuit which alleges that it routinely underpaid its female employees, held back promotions and condoned sexual harassment. Cases like these should have all employers taking a second look to ensure that they are treating women properly in the workplace.

While this was a US based lawsuit, Ontario has significant protections in place for women in the workplace. Under the Human Rights Code, employees have protections in place to ensure that they are not subject to differential treatment as a result of their sex. Women are also entitled to certain levels of pay transparency and equality under the Pay Equity Act.

Employers that fail to treat its female employees equally can face steep consequences. The human Rights Tribunals can award significant damages for lost wages and injury to dignity, feelings and self-respect, among others.  Employers are also under an obligation to investigate allegations of discrimination and sexual harassment to ensure that its employees are protected properly in the workplace.
