Most recently, two Black employees at TikTok have filed discrimination claims in which they allege they experienced a hostile work environment at the company. The more specific allegations relate to racial discrimination and retaliation for raising concerns about the same. As a result, they also claim that they did not receive promotions and were subjected to insensitive comments.
What Legislation Protects Employees Against Discrimination and Retaliation in Ontario?
There are a wide range of allegations, too. Employees allege that as each of their trajectories progressed, they were portrayed by other workers as angry and illogical, while at the same time overburdened with work and provided low-quality work at that. The legislation under which these claims were brought is not unlike the legislation we have here in Ontario. While the Human Rights Code protects against discrimination on the basis of race as well as retaliation, the Occupational Health and Safety Act protects against unlawful reprisal after the raising of harassment and discrimination complaints.
It is important for employers to develop effective ways to manage and deal with workers’ concerns with it comes to discrimination. While Black workers make up only 8% of tech workers in the US, they represent approximately 50% of of workers who have experienced discrimination (for reference, among other racialized groups around 25% of workers have experienced discrimination).
